Phong is a cool, calm, measured and focussed senior Thai lawyer and the Managing Partner of the Hughes Krupica Bangkok office with the skills of being able to handle both litigation and transactions well. Phong believes in ensuring he has collected the facts relating to a client matter, spend the appropriate time to analyse the facts and law, before issuing conclusive opinions.
Phong manages a small but highly competent team of commercial transaction lawyers and litigators. He connects well with foreign clients and Thai clients, and with his excellent command of English, can deliver advice in either English or Thai as the case may be.
In any given working week Phong can be found attending court as senior counsel on a client’s litigation case, handling an auction for execution of assets, completing a condominium unit transfer, overseeing the due diligence on land title in another Province, followed by working as lead Thai counsel on arbitration cases.
Phong is dynamic, friendly, reliable, articulate and a team player. He will always do his best for clients and the firm.
16 Years Experience in Litigation and Transactional Legal Work
The depth of Phong’s experience is a key asset to the firm and clients and that is why he is Managing Partner of the Bangkok office. Bangkok’s diverse dynamic foreign investment activities suit Phong well and this is an environment in which Phong is able to deliver high quality legal services through his own efforts and the team around him in a timely and competitive manner.
Foreign Investment Friendly Adviser
Phong has a good track record of leading clients through the Board of Investment (BOI) process together with our Senior Associate, Bowornsith Nitiyavanich (Chai). Often clients assume that using the BOI’s system will be relatively easy and perhaps legal assistance is an unnecessary expense. Often clients then realise that some of the application processes and presentations required to navigate through the approvals process are complex enough to warrant additional expense to add value to obtaining the privileges of a BOI certificate.
Sharp; Shrewd; Ethical; Strategic Litigation
Good litigators know when to hunt alone and hunt in packs. Phong is able to handle small medium litigation himself if he needs to or wishes to provide personal service to a long standing client. On larger litigation matters, Phong will work in a team of litigators and devote appropriate time to strategic planning and thinking, to prepare evidence properly, think about witness statements and testimony with the appropriate advance planning required, and provide good clear reporting to clients on upcoming hearings, and the results of hearings.
During settlement negotiations, you can trust that Phong will be providing you with the true analysis of the other’s sides approach, their offers, his view on their offers, and recommendations on how to proceed. If your objective is to achieve a settlement, that is what Phong will help you steer the process towards. If your objective is a bloody battle of prevarication and rain showers of notices and motions, Phong can handle that too. He will always provide you with an opinion on the likely outcome of agreed tactics in litigation.
A Generalist with Refined Skills in Practice
Phong can do many things, and well. The issues on which he has assisted clients has shaped him as an adviser and provides value to new clients seeking experience.
For commercial matters, Phong is up to speed with the practices required to amend international trade agreements between entities within a supply chain.
For corporate matters, Phong will take a joint venture, private company investment or takeover – in his stride.
For real estate matters, Phong will go beyond tinkering with a sale and purchase agreement to ensure if you need it you will receive holistic advice about a deal, good practical targeted due diligence and post completion assistance.
Phong has also worked with Victor Smith and Desmond Hughes on a variety of arbitration matters and continues to develop our Bangkok’s arbitration practice to accommodate clients involved in disputes governed by arbitration.
Phong will find the time to visit other countries with his family, and throughout the course of they year he will be on weekend mini-breaks in Hong Kong, Singapore, Vietnam and further afield. He will also make the effort to travel domestically within Thailand to enjoy one of his favourite activities – cycling and running.
Phong will participate in running and cycling competitions where he is able to, and aside from cycling he is also able to handle touring motorbikes having previously owned a Ducati before trading that in for 2 wheels and no engine. Phong also enjoys scuba diving.
